These Terms of Service explain the rules that apply when you visit ultracoatpro.co.uk, create an account or purchase products from us. Please read them carefully before placing an order.

This website and online store are operated by LEXPER LTD trading as ULTRACOAT UK (“ULTRACOAT UK”, “we”, “us” or “our”). LEXPER LTD is a company registered in England and Wales under company number 16308806, with its registered office at 66 Paul Street, London, England, EC2A 4NA.

By using this website or placing an order, you agree to these Terms. If you do not agree to them, please do not use the website or place an order.

1. Scope of these Terms

These Terms apply to:

  • your use of this website;
  • orders placed through our online store;
  • consumer purchases;
  • approved Trade, PRO and Reseller purchases, unless separate written terms apply.

Our Shipping Policy, Return and Refund Policy and Privacy Policy also apply and form part of these Terms.

If you are purchasing wholly or mainly for purposes connected with your trade, business, craft or profession, you are a business customer. Certain consumer protections referred to in these Terms may not apply to business customers.

2. Eligibility to place an order

By placing an order, you confirm that:

  • you have the legal capacity to enter into a contract;
  • the information you provide is accurate and complete;
  • you are authorised to use the selected payment method; and
  • if ordering on behalf of a business, you have authority to bind that business.

If you are under 18, you should only place an order with the involvement and permission of a parent or legal guardian.

3. Website use

You may use this website only for lawful purposes. You must not:

  • use the website fraudulently or for any unlawful activity;
  • attempt to gain unauthorised access to the website, customer accounts, servers or systems;
  • introduce viruses, malicious code or other harmful material;
  • scrape, copy or commercially exploit website content without our permission;
  • interfere with the security, availability or proper operation of the website;
  • use false details, impersonate another person or place orders without authority; or
  • use the website in a way that infringes another person’s rights.

We may suspend or restrict access where reasonably necessary to protect our customers, systems or business, or where we reasonably believe these Terms have been breached.

4. Products and product information

We take reasonable care to ensure that product descriptions, specifications, prices and images are accurate. However:

  • colours and appearance may vary slightly depending on your screen or device;
  • product packaging may change without notice;
  • minor differences that do not materially affect the product may occur; and
  • availability and stock levels may change at any time.

Nothing in this section affects your legal rights where a product is faulty, not as described or not fit for its intended purpose.

5. Product safety and correct use

Automotive detailing and surface-care products must be used correctly. Before using a product, you must read and follow all instructions, warnings and safety information provided on the label, packaging, product page or safety data sheet.

You are responsible for:

  • checking that the product is suitable for the intended surface and application;
  • performing a test in an inconspicuous area where appropriate;
  • using suitable personal protective equipment;
  • providing appropriate ventilation;
  • storing and disposing of products safely; and
  • keeping products away from children and animals.

Products described as professional, accreditation-only or restricted-use products should be used only by appropriately trained or authorised persons. Do not mix products unless the product instructions expressly permit it.

These responsibilities do not limit your statutory rights or our responsibility for unsafe, faulty or incorrectly described products.

6. Orders and contract formation

When you place an order, you are making an offer to purchase the products in your basket. An automated order acknowledgement confirms that we have received your order, but it does not by itself mean that we have accepted it.

A binding contract is formed when we send you confirmation that your order has been dispatched, unless we expressly confirm acceptance at an earlier stage.

Before accepting an order, we may carry out payment, address, fraud-prevention and availability checks. We may decline or cancel an order before acceptance for legitimate reasons, including:

  • the product is unavailable;
  • payment could not be authorised;
  • the delivery address is outside an area we serve;
  • we identify suspected fraud or misuse;
  • the order breaches product restrictions or purchase limits;
  • there is an obvious pricing or description error; or
  • we reasonably believe the order is intended for unauthorised commercial resale.

If payment has already been taken for an order that we do not accept, we will refund the amount paid to the original payment method.

7. Prices, taxes and payment

Prices are displayed in pounds sterling (GBP) and include applicable taxes where required. Delivery charges and any available delivery services are shown separately during checkout.

We may change prices at any time, but changes will not affect an order that we have already accepted.

If a price is obviously incorrect, we may contact you before accepting the order and give you the option to proceed at the correct price or cancel. If an obvious pricing error is discovered after acceptance, we will contact you and act in accordance with applicable law.

Payments are processed through Shopify and the payment providers displayed at checkout. Your use of a particular payment service may also be subject to that provider’s terms and privacy policy.

Discount codes and promotions:

  • must be used in accordance with their stated conditions;
  • may have expiry dates, product exclusions or minimum-spend requirements;
  • cannot be exchanged for cash;
  • may not be combined unless expressly stated; and
  • may be withdrawn or corrected where they have been published or issued in error, subject to applicable law.

8. Delivery

We currently deliver only to eligible UK destinations made available during checkout. Certain postcodes, territories or delivery services may be unavailable or subject to additional restrictions.

Delivery services, charges, qualifying thresholds, dispatch times and estimated transit times are set out in our Shipping Policy and at checkout.

Delivery dates and times are estimates unless we expressly agree otherwise. We are not responsible for delays caused by events outside our reasonable control, but this does not affect your statutory rights. Unless a different period has been agreed, consumer orders will be delivered within the time required by applicable law.

You are responsible for providing a complete and accurate delivery address. If an order is returned or delayed because the address supplied was incorrect or incomplete, we may ask you to pay reasonable redelivery costs, unless the error was ours.

For consumer orders, responsibility for the goods passes to you when the goods are delivered into your physical possession, or to a person identified by you to receive them.

9. Ownership of goods

Ownership of the goods passes to you only after we have received payment in full and the goods have been delivered.

10. Cancelling an order

If you wish to cancel an order before dispatch, contact us as soon as possible at info@ultracoatpro.co.uk. We will try to stop the order, but we cannot guarantee cancellation once it has entered the fulfilment or carrier process.

If the order has already been dispatched, you may still have the right to cancel and return it in accordance with our Return and Refund Policy.

11. Returns, refunds and faulty products

Our return process, cancellation period, return conditions, exclusions and refund times are explained in our Return and Refund Policy.

If you are a UK consumer, your legal rights are not affected by these Terms. Products must be of satisfactory quality, fit for their intended purpose and as described.

If a product is faulty, damaged on arrival, incorrectly supplied or not as described, please contact us promptly. Where we are responsible for the problem, we will cover reasonable return costs and provide the remedy required by law.

For eligible change-of-mind returns, the customer is responsible for return postage unless we agree otherwise.

12. Consumer cancellation rights

UK consumers purchasing online normally have the right to cancel eligible orders within 14 days after receiving the goods, without giving a reason. After notifying us of the cancellation, the goods must normally be returned within a further 14 days.

Exceptions may apply to certain products, including personalised goods, goods that deteriorate quickly and sealed goods that are not suitable for return for health or hygiene reasons once unsealed. Full information is provided in our Return and Refund Policy.

Where applicable, we may reduce a refund to reflect a loss in value caused by handling beyond what would reasonably be permitted when examining the product in a shop.

Do not send products to our registered office unless our returns instructions specifically tell you to do so.

14. Trade, PRO and Reseller customers

Trade, PRO and Reseller accounts are subject to approval and may be subject to additional written terms, pricing arrangements, programme rules or agreements. If separate written terms conflict with these Terms, the separate written terms will take priority for the relevant business transaction.

Unless we expressly authorise you in writing, you must not:

  • represent yourself as an authorised ULTRACOAT distributor, reseller, installer or accredited PRO studio;
  • use our trademarks, branding or marketing materials for commercial purposes;
  • resell restricted or professional products;
  • make product claims that we have not approved; or
  • alter, relabel, repackage or remove safety information from products.

If you purchase wholly or mainly for business purposes, you confirm that you are not acting as a consumer. Consumer cancellation rights may not apply to business purchases.

15. Customer accounts

You are responsible for maintaining the confidentiality of your account details and for activity carried out through your account. Please notify us promptly if you believe your account has been accessed without permission.

We may suspend or close an account where reasonably necessary because of suspected fraud, misuse, security concerns, breach of these Terms or termination of an approved Trade, PRO or Reseller relationship.

16. Reviews, comments and other content

If you submit a review, photograph, comment or other content to us, you retain ownership of that content. You grant us a non-exclusive, worldwide, royalty-free licence to host, reproduce, display and use the content for operating and promoting our business and products.

You confirm that:

  • you own the content or have permission to submit it;
  • the content is accurate and based on genuine experience where presented as a review;
  • the content does not infringe intellectual property, privacy or other rights;
  • the content is not unlawful, threatening, defamatory, misleading or offensive; and
  • the content does not contain malicious code or unauthorised personal information.

We may remove content where reasonably necessary for legal, security or moderation reasons. We will not knowingly publish fake or misleading reviews.

17. Intellectual property

All website content, including text, graphics, product photographs, videos, logos, icons, page designs and software, is owned by or licensed to us and is protected by intellectual property law.

You may view and use the website for personal or authorised business purchasing purposes. You must not reproduce, distribute, modify, publish, sell or commercially exploit website content without prior written permission from the relevant rights holder.

ULTRACOAT names, logos and product branding are trademarks or protected brand assets of their respective owners. No licence to use them is granted except where expressly agreed in writing.

18. Third-party services and links

Our store is hosted by Shopify. We may also use third-party payment providers, carriers, analytics services and other technology providers to operate the website and fulfil orders.

Shopify may process information from your interactions with our store, other Shopify merchants and Shopify to provide and improve services including security, fraud prevention, analytics, personalisation and, where the required consent has been provided, advertising. Information may be processed by Shopify and its service providers in countries outside the United Kingdom. Further information is available in the Shopify Consumer Privacy Policy and through the Shopify Privacy Portal.

Links to third-party websites are provided for convenience. We do not control those websites and are not responsible for their content, availability or privacy practices. Your use of third-party services may be governed by their own terms.

19. Website availability and security

We aim to keep the website accurate, secure and available, but we do not guarantee uninterrupted or error-free access. We may temporarily suspend access for maintenance, updates, security work or circumstances outside our reasonable control.

You are responsible for ensuring that your device, software and internet connection are suitable and secure.

20. Privacy

We process personal information in accordance with our Privacy Policy. This explains what information we collect, why we use it, who we share it with and the rights available to you.

21. Our liability to consumers

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:

  • death or personal injury caused by negligence;
  • fraud or fraudulent misrepresentation;
  • defective products where liability cannot lawfully be excluded;
  • breach of your statutory consumer rights; or
  • any other liability that cannot be excluded or limited by law.

If you are a consumer, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for loss or damage that was not foreseeable, or for business losses suffered by a person purchasing as a consumer, including loss of profit, revenue, opportunity or business interruption.

We are not responsible for damage caused by misuse, failure to follow product instructions, use on an unsuitable surface, unauthorised modification or mixing products contrary to their instructions, except where the damage results from a faulty or incorrectly described product or from our negligence.

22. Our liability to business customers

If you are a business customer, nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of title, defective products where liability cannot lawfully be excluded, or any other liability that cannot be excluded by law.

Subject to the paragraph above and to the fullest extent permitted by law:

  • we are not liable for indirect or consequential loss;
  • we are not liable for loss of profit, revenue, business, contracts, anticipated savings, goodwill or data; and
  • our total liability arising from an order will not exceed the amount paid for the products giving rise to the claim.

Nothing in this section affects any separate written terms agreed with an approved Trade, PRO or Reseller customer.

23. Events outside our control

We are not responsible for delay or failure caused by events outside our reasonable control, including severe weather, carrier disruption, industrial action, fire, flood, accident, public authority action, import or transport restrictions, network failure or interruption of essential services.

If such an event affects your order, we will take reasonable steps to minimise the delay and keep you informed. If the delay becomes substantial, you may contact us to cancel the affected order and receive a refund for products not supplied, subject to your legal rights.

24. Changes to these Terms

We may update these Terms to reflect changes in our business, services, technology or legal obligations. The updated version will be published on this page with a revised “Last updated” date.

Changes will not retrospectively alter the terms of an order that we have already accepted, unless the change is required by law or you expressly agree to it.

25. Severability and waiver

If any part of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue in effect.

If we do not immediately enforce a right under these Terms, this does not mean that we have waived that right.

26. Transfer of rights

We may transfer our rights and obligations under these Terms to another organisation, for example as part of a business reorganisation, provided that this does not reduce the rights of a consumer.

You may transfer your rights under a consumer contract where the law permits. Any other transfer requires our written agreement.

27. Governing law and disputes

These Terms and any contract between you and us are governed by the laws of England and Wales.

If you are a consumer living in Scotland or Northern Ireland, you retain any mandatory protections available under the laws of the part of the UK in which you live. You may bring legal proceedings in the courts of the part of the UK where you live or in the courts of England and Wales.

If you are a business customer, the courts of England and Wales will have exclusive jurisdiction over disputes arising from these Terms or an order.
